Framed issue hearing required on issue of whether father-pedestrian struck in NY met definition of resident of insured’s (son’s) household in Maine on proof he spends a portion of each year at son’s address where he keeps personal items, has a bedroom, furnishes the house, landscapes the yard with his son, and holds the mortgage. Adding the father to the policy as a “driver” did not automatically define him as a resident of the household. Both sides agreed a framed issue hearing was reasonable. Matter of Travelers Home & Mar.
